1. Definitions

• “You,” “Your” refer to the customer using our Services.
• “Goods” refer to the items being transported by us.

2. Services

ClearPath Logistics Ltd offers courier and delivery services, including but not limited to collection, transportation, and delivery of letters, parcels, crates, fragile goods, and pallets throughout the UK. The exact nature of the Services will be agreed upon when you book with us.

3. Booking and Payment

• To use our Services, you must provide accurate and complete information, including delivery addresses and contact details.
• All bookings are subject to availability and acceptance by us.
• Payment is required at the time of booking unless otherwise agreed. We accept major credit/debit cards and other payment methods as specified on our website.
• Prices quoted are exclusive of VAT unless stated otherwise.

4. Payment Terms

• Payment on Delivery (POD): Payment for our services is due immediately upon completion of delivery unless otherwise agreed in writing. Failure to make payment upon delivery may result in a delay or suspension of future services.
• Payment on Account (POA): Customers who have established a credit account with us must adhere to the agreed payment terms, typically 30 days from the date of invoice, unless otherwise specified. Late payments may incur additional charges or interest at the statutory rate.
• We reserve the right to suspend or terminate services for any customer who fails to comply with these payment terms.

5. Collection and Delivery

• We will make reasonable efforts to collect and deliver Goods at the agreed times, but we do not guarantee exact delivery times due to unforeseen circumstances (e.g., traffic, weather).
• You must ensure that Goods are properly packaged, labeled, and ready for collection. We are not liable for damage caused by inadequate packaging.
• We reserve the right to refuse to transport any Goods that are illegal, hazardous, perishable, or otherwise unsuitable for transportation.

6. Cancellations and Amendments

• You may cancel or amend a booking by contacting us directly. Cancellations made less than 24 hours before the scheduled collection time may be subject to a cancellation fee.
• ClearPath Logistics Ltd reserves the right to cancel or amend a booking in exceptional circumstances. In such cases, we will notify you promptly and provide a full refund if applicable.

7. Liability and Insurance

• Our liability for loss, damage, or delay of Goods is limited to £50 per consignment unless you have purchased additional insurance coverage or a higher limit is agreed in writing.
• We are not liable for any indirect, consequential, or special damages, including but not limited to loss of profits, business, or anticipated savings.
• We do not accept liability for damage to Goods resulting from inadequate or improper packaging.

8. Insurance Options

• We offer additional insurance coverage for Goods upon request. Please contact us for more information on available options and pricing.
• It is your responsibility to declare the value of the Goods accurately when purchasing additional insurance. Any misrepresentation of the value may void the coverage.

9. Complaints and Claims

• All complaints and claims must be submitted in writing within 7 days of the delivery date. Please provide full details, including the consignment number and supporting documentation.
• We will investigate and respond to your complaint or claim within a reasonable timeframe.

10. Data Protection

• We are committed to protecting your personal data in accordance with our Privacy Policy. By using our Services, you agree to the collection and use of your data as outlined in our Privacy Policy.

11. Force Majeure

• ClearPath Logistics Ltd is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, accidents, traffic delays, or governmental actions.

12. Governing Law

• These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Amendments

• We reserve the right to amend these Terms at any time. Any changes will be posted on our website, and continued use of our Services constitutes acceptance of the revised Terms.
